§ 28-4. In general.
This chapter establishes a legal framework for sign regulation within the jurisdiction.
(1)
Public considerations. No sign or related structure shall be approved or erected in contravention to public life, health, safety and welfare considerations as outlined below and a sign or related structure so constructed constitutes a violation of this chapter:
a.
Signs erected which obstruct the view of the operators of motor vehicles on public streets or entering such streets from private property.
b.
Signs erected or in the process of being erected constituting a public hazard or an obstruction to building egress, such as a window or door.
c.
Signs supported on or attached to any fire escape, door, or window casing.
d.
Signs with damage, deterioration or other defects constituting a hazard to public life, health, safety and welfare.
e.
Revolving beam or beacon of light resembling any emergency vehicle light and signs resembling traffic control signs.
f.
Signs which encroach or project over city public property or right-of-way except as expressly authorized in this chapter.
g.
Portable signs except as expressly authorized in this chapter.
h.
Digital display signs configured to resemble a warning or danger signal or are otherwise easily confusable with a warning or danger signal.
i.
Digital display signs resembling or simulating any lights or official signage used to control traffic in accordance with the 2003 Manual on Uniform Traffic Control Devices, with Revision No. 1 published by the Federal Highway Administration (FHWA).
j.
Signs emitting excessive luminance.

City authority. Any purported city authorization to erect a sign in violation of subsection (1) above is invalid and is automatically rescinded. Nothing herein shall be construed so as to restrict or prohibit lawful sign erection in compliance with this chapter. The city is authorized to evaluate and alleviate the life, safety, health and welfare concern of a sign or related structure 1) constructed; 2) in the process of being constructed; 3) damaged; or 4) otherwise deteriorated; - all so as to present a clear and present danger to the public by any reasonable means necessary under the circumstances then existing as a valid exercise of its police powers. Costs associated with alleviating the sign or related structure shall be forwarded to the sign owner for immediate remittance.
