§ 35-B115. Plat Vacation and Resubdivision.

  • (a)

    Number of Copies The director of planning and development services may require the applicant to submit the original vacating declaration and up to thirteen (13) copies with respective department/agency request for reviews and two (2) legible eight and one-half by eleven (8½ x 11) inch reduced copies of the plat being vacated attached. In addition, the submittal shall include (2) full size copies of the original plat folded prints together with the required processing fee. A vacating declaration processing fee and copies as listed above are not required in connection with the processing of a resubdivision plat.

    (b)

    Format. All filed plat copies shall clearly delineate the area to be vacated.

    (c)

    Contents. The applicant shall include the names and addresses of all owner of lots within the subdivision and their signed written consent.

    (d)

    Certification. The resubdivision plat shall be annotated generally as follows:

    The area being resubdivided in this plat had been previously platted on plat no. _____ known as ________ subdivision which is recorded in volume _____ page _____, County Plat and Deed Records, and was vacated through a vacating declaration being recorded on the same date as this resubdivision plat.
