§ 35-305. Zoning District Boundaries.

  • When definite distances in feet are not shown on the zoning map, the following rules shall apply:

    (a)

    Boundaries indicated as approximately following the right-of-way or centerlines of streets, highways, or alleys shall be construed to follow such right-of-way or centerlines;

    (b)

    Boundaries indicated as approximately following platted lot lines shall be construed as following such lot lines;

    (c)

    Boundaries indicated as approximately following city limits shall be construed as following city limits;

    (d)

    Boundaries indicated as following railroad lines shall be construed to be midway between the main tracks;

    (e)

    Boundaries indicated as approximately following the centerlines of streams, rivers, canals, lakes, or other bodies of water shall be construed to follow such centerlines;

    (f)

    Whenever any street, alley or other public way not subject to zoning regulations is vacated by official action of the city council, or whenever such area is franchised for building purposes, the zoning district line adjoining each side of such street, alley or other public way shall be automatically extended to the center of such vacation, and all area so involved shall then and henceforth be subject to all regulations of the extended districts;

    (g)

    Where physical or cultural features existing on the ground are at variance with those shown on the official zoning maps, or in other circumstances not covered by the foregoing, the director of planning and development services shall interpret the district boundaries with appeal to the board of adjustment.

    (h)

    In order to correct survey errors in courses or distances, scrivener errors, or clerical errors, if a parcel is rezoned and a remainder strip of less than fifty (50) feet is inadvertently not included in the rezoning, the entire parcel will be considered rezoned.
