§ 35-492. Violation of Conditions.

  • (a)

    Penalty. The violation of any condition imposed pursuant to a development order or a permit pursuant to this chapter including, but not limited to, a specific use authorization, conditional zoning district or special exception, shall constitute a violation of this chapter and may be prosecuted in municipal court regardless of whether civil or administrative action is taken against the permit holder. Upon conviction, the permit holder shall be subject to the penalties prescribed in subsection 35-491(c)(2) of this chapter.

    (b)

    Revocation of Permit. The director of development services is authorized to issue any administrative order necessary to terminate or suspend a use found, as a result of the administrative process noted in section 35-406, to be in violation of a condition.

    (c)

    Civil Action. The director of development services may request the city attorney to institute a civil action as prescribed in subsection 35-491(a) of this chapter regardless of whether a criminal or administrative action is taken against the permit holder.
