§ 35-497. Sexually Oriented Businesses.
(a)
A person commits an offense if the person violates any provision of the sexually oriented business regulations in this chapter. An offense under this section is a class A misdemeanor offense, and upon conviction thereof, shall be punished by:
(1)
A fine not to exceed four thousand dollars ($4,000.00);
(2)
Confinement in jail for a term not to exceed one (1) year; or
(3)
Both such fine and confinement.
(b)
In addition to the criminal sanctions authorized by this section the subsection, the city attorney is authorized to bring a civil action in law or equity against any party who violates any provision of this section. The city attorney may bring a civil action against a party without first seeking criminal sanctions.
