§ 35-718. Effect of Expired Project or Permit.

Any right or restriction established by this division 2 or by Chapter 245 by the filing of an application for an initial permit for a project is extinguished when:

(1)

That permit expires due to the failure of the property owner to initiate the activity authorized by the permit and a new permit is required to take an action necessary to initiate the project for which the expired permit was required; or

(2)

That permit expires and the action authorized by the permit was not completed and a new permit is required to take an action necessary to initiate the project for which the expired permit was required; or

(3)

The project expires in accordance with the provisions of this chapter.
